    Presentation
    Created in 1993, the Joint Court of Justice and Arbitration of the Organisation for the Harmonisation of Business Law in Africa (OHADA) is not solely involved in administering arbitrations. The Court is primarily Judge of Cassation, in replacement of the National Cassation Courts, for every litigation regarding the uniform business law. It gives advice on draft legal texts, called "uniform acts" for the sixteen-country-OHADA zone. The Court also administers arbitrations under its own rules.
    Functions
    Regarding arbitration, the Joint Court of Justice and Arbitration organises and supervises arbitrations: it appoints and confirms arbitrators, is informed of the request's process and examines draft awards, for which it can only suggest as to form amendments. The Joint Court of Justice and Arbitration's Rules of procedure were adopted by the Council of Ministers of Justice and Finance of OHADA in 1996. These rules concern the Court's organisation (election and functions of the chairman, judges and clerks of the Court, constitution of the Chambers…), as well as the litigation and consultative procedures.
